‘Rust’ Prosecutor Steps Down After Alec Baldwin’s Defense Calls For Her Removal

After Alec Baldwin‘s defense team called for her removal, special prosecutor Andrea Reeb announced Tuesday (March 14) that she will be stepping down from the involuntary manslaughter case filed against the actor.

“After much reflection, I have made the difficult decision to step down as special prosecutor in the Rust case,” Reeb said in a statement. “My priority in this case – and in every case I’ve prosecuted in my 25-year career – has been justice for the victim.”

She continued, “However, it has become clear that the best way I can ensure justice is served in this case is to step down so that the prosecution can focus on the evidence and the facts, which clearly show a complete disregard for basic safety protocols led to the death of Halyna Hutchins.”

Reeb’s resignation comes just a month after Baldwin’s defense team asked to have her removed from the case. They filed a motion in February arguing Reeb could not serve as a prosecutor in the case because she is also an elected member of the New Mexico House of Representatives, which the defense claimed violated the state’s constitution.

In a statement at the time, District Attorney Mary Carmack-Altwies called this a tactic “to distract from the fact that Halyna Hutchins died because of gross negligence and a reckless disregard for safety on the Rust film set.”

Baldwin and Rust armorer Hannah Gutierrez-Reed are both currently facing charges for involuntary manslaughter after Hutchins, the Rust cinematographer, was fatally shot on set in 2021. Baldwin’s team recently got the D.A. to reduce the charges last month, dropping the firearm enhancement that could have added five years to their prison sentence if convicted. 

In a 2021 interview with ABC News, Baldwin maintained that he didn’t pull the trigger on the gun that killed Hutchins. He said, “I would never point a gun at anyone and then pull the trigger, never. Someone put a live bullet in the gun, a bullet that wasn’t even supposed to be on the property.”

Baldwin was accused of “reckless deviation from known standards and practice and protocol” while on set prior to Hutchins’ death. Prosecutors stated that he failed to complete firearms training. Baldwin allegedly only appeared for 30 minutes of an hour-long training session with Gutierrez-Reed, during which he was “distracted and talking on his cell phone to his family.”

Baldwin pleaded not guilty last month.
