Alec Baldwin May Be Charged Again in ‘Rust’ Shooting After Forensic Report Reveals Trigger Was Pulled on Gun

Alec Baldwin could be charged again in the death of Halyna Hutchins after a new forensic examination of the prop gun he had been holding on set the day of the shooting.

Baldwin, who was facing charges of involuntary manslaughter that were dropped earlier this year, has long maintained that he did not pull the trigger on the prop gun which fired a live round and killed Hutchins and injured director Joel Souza. His defense claimed the gun had been modified, suggesting it may not have been working properly.

But a new forensic examination of the gun found that the gun could only fire if the trigger had been pulled, Variety reports.

“This fatal incident was the consequence of the hammer being manually retracted to its fully rearward and cocked position followed, at some point, by the pull or rearward depression of the trigger,” a report obtained by Variety states. “Although Alec Baldwin repeatedly denies pulling the trigger, given the tests, findings and observations reported here, the trigger had to be pulled or depressed sufficiently to release the fully cocked or retracted hammer of the evidence revolver.”

The forensic examination, which was ordered by special prosecutors Kari Morrissey and Jason Lewis, could mean that charges will be refiled against Baldwin.

The report also examined the rounds found on set, since Hutchins died after being struck by a live round that should not have been used.

Hannah Gutierrez Reed, the armorer who worked on Rust at the time of the fatal shooting, claimed the live rounds used in the shooting had been mixed in with the dummy rounds by weapons supplier Seth Kenney.

But the report concluded that the rounds were dissimilar to the rounds they seized from Kenney following the shooting.

She is still facing charges of involuntary manslaughter and evidence tampering, and is set to stand trial in December.

Morrissey told Variety that they expect the decision to charge Baldwin again will be “forthcoming.”
