‘Yellowstone’s CBS Debut Raises FCC Concerns Surrounding Smoking On Primetime Television

Fans of Yellowstone are well aware that Beth Dutton (Kelly Reilly) has smoked her fair share of cigarettes on-screen. However, with the show’s recent debut on primetime television on CBS, her smoking raises concerns surrounding the Federal Communications Commission’s (FCC) protocol.

According to the FCC’s website, “stations are prohibited from broadcasting material that promotes certain lotteries,” including advertising the use of cigarettes. This standard is aligned with the Federal Trade Commission’s (FTC) Federal Cigarette Labeling and Advertising Act, which “prohibits any advertising of cigarettes and little cigars on radio, television, or other media regulated by the [FCC].” This targets major networks, such as CBS.

However, characters who smoke on shows produced by streaming services such as Netflix (think Hopper on Stranger Things and Klaus on The Umbrella Academy) experienced a sort of resurgence in recent years. A 2018 study conducted by the Truth Initiative found that 79% of shows most popular with young people ages 15-24 depict tobacco use.

Reilly told Entertainment Tonight in January that doesn’t smoke in real life, and thus uses herbal cigarettes while filming. She even suggested that Beth try Nicorette gum instead.

“I hate them so much and [series creator Taylor Sheridan] has it in the script when she’s smoking and when she takes a drag, it’s all written,” she said. “And so I’m trying to pitch him an idea that she gets addicted to Nicorette gum. So we’ll see next year if she’s smoking or not.”

The Western drama that originally aired on the Paramount Network in 2018 has begun airing reruns in light of the ongoing WGA and SAG-AFTRA strikes in order to fill up air time. As noted by Roger Friedman on Showbiz 411, Yellowstone also features sexual content that previously would be avoided on primetime TV, and its CBS debut comes out of “necessity.”

Yellowstone is now airing weekly reruns on CBS. All five seasons of the series are available to stream on Peacock Premium.
