Alec Baldwin’s ‘Rust’ Involuntary Manslaughter Charges Resurface in New Mexico: “Additional Facts Have Come To Light”

Alec Baldwin will go before a grand jury in New Mexico following him fatally shooting cinematographer Halyna Hutchins and injuring director Joel Souza on the set of Rust in 2021.

According to Variety, special prosecutors Kari Morrissey and Jason Lewis released the following statement:

“After extensive investigation over the past several months, additional facts have come to light that we believe show Mr. Baldwin has criminal culpability in the death of Halyna Hutchins and the shooting of Joel Souza. We believe the appropriate course of action is to permit a panel of New Mexico citizens to determine from here whether Mr. Baldwin should be held over for criminal trial.”

Luke Nikas, Baldwin’s attorney said, “it is unfortunate that a terrible tragedy has been turned into this misguided prosecution,” and that they “will answer any charges in court.”

If Baldwin is convicted, the charge could signify up to 18 months in prison, per NBC News. The outlet reported that the grand jury is slated to convene around mid-November.

Hannah Gutierrez-Reed, the film’s armorer, has also been charged with involuntary manslaughter and has pleaded not guilty. She is set to be tried in Santa Fe, New Mexico in February, and could be sentenced to up to three months in jail if convicted, per Variety.

According to The New York Times, Morrissey said that “the forensic testing of the gun concluded with certainty that the trigger of the gun had to have been pulled for the gun to go off.”

However, in an interview with ABC News’ George Stephanopoulos aired in Dec. 2021, Baldwin claimed that the “trigger wasn’t pulled.”

The tragic incident took place on Oct. 21, 2021, when Baldwin was preparing for a scene rehearsal where he would draw a Colt .45 revolver. While he was reportedly told by assistant director Dave Halls that the gun was “cold” — meaning that it had no live ammo in it — the gun fired a live round, killing Hutchins and injuring Souza in the process.

After being charged with manslaughter in January, the actor’s charges were dropped in April, but Morrissey and Lewis noted that they could be refiled following “further investigation,” per Deadline.
