Alec Baldwin Facing 18 Months In Jail After Being Indicted (Again!) For Involuntary Manslaughter In Shooting Of ‘Rust’ Cinematographer Halyna Hutchins

Alec Baldwin has been indicted on two counts of involuntary manslaughter for the fatal shooting of Rust cinematographer Halyna Hutchins.

“We look forward to our day in court,” Baldwin’s attorneys said in a statement, per Variety.

The indictment comes after the manslaughter charges were initially dropped in April 2023 after Baldwin’s defense team argued that the Colt .45 that was fired on set and subsequently killed Hutchins was not functioning properly. Baldwin has maintained that he did not pull the trigger, but after further forensic testing, it was found that the gun could only have been fired by someone pulling the trigger.

According to Variety, the forensic report stated, “Although Alec Baldwin repeatedly denies pulling the trigger, given the tests, findings and observations reported here, the trigger had to be pulled or depressed sufficiently to release the fully cocked or retracted hammer of the evidence revolver.”

Baldwin faces up to 18 months in prison if convicted.

Hannah Gutierrez Reed, Rust armorer, mistakenly loaded a live bullet instead of a dummy round into Baldwin’s gun, per Variety. She is still expected to go on trial next month, where she will be facing charges of involuntary manslaughter and evidence tampering.

The fatal shooting took place as Baldwin was preparing to film a rehearsal in October 2021. He was reportedly told by assistant director Dave Halls that the gun was “cold” — meaning that it had no live ammo in it. The gun then fired, killing Hutchins and injuring director Joel Souza in the process.

Rust continued filming amidst the ongoing trial, with Hutchins’ husband attached as an executive producer following the settlement her estate reached with Baldwin and Rust Movie Productions LLC.

In an October 2022 settlement announcement, Matthew Hutchins wrote, “All of us believe Halyna’s death was a terrible accident. I am grateful that the producers and the entertainment community have come together to pay tribute to Halyna’s final work.” 

Filming on Rust concluded in May 2023, which Baldwin celebrated with a post on social media.

“It’s been a long and difficult road. But we reach the ned of the trail today. Congratulations to Joel, Bianca and the entire cast and crew. Nothing less than a miracle,” he wrote at the time.
