Home Alone actor Devin Ratray‘s domestic violence trial has been delayed following his recent hospitalization.

The actor was admitted to the hospital “in critical condition,” though the circumstances surrounding the incident are still unclear, TMZ reports. A family member close to Ratray confirmed he has already been released and is now recovering at home.

Ratray, who is best known for playing the mean older brother to Macauley Culkin‘s character in Home Alone, is facing domestic assault and battery by stangulation charges in the Oklahoma trial following a domestic dispute with his girlfriend. Ratray’s trial was set to undergo jury selection this coming Monday; it has now been pushed back to February.

He was arrested and charged back in in December 2021 with punching and strangling his ex-girlfriend after she allegedly gave his autograph away to fans without asking for money, per Page Six. Ratray, who had reportedly been drinking throughout the night, allegedly assaulted her in their hotel room later that evening. According to the affidavit, which was obtained by KFOR, Ratray held one hand over her mouth and pressed down on her throat with the other hand during the altercation.

“This is how you die,” he reportedly said as he choked her.

The affidavit mentions the victim sustained multiple injuries during the altercation, including bruising and marks around her eyes, a bruise on her chest, and soreness in her right arm.

Ratray turned himself in to police, per KFOR. His attorney, Scott Adams, denied any wrongdoing, telling the outlet, “Mr. Ratray denies he ever laid a hand on her or did anything in regards to anything like that.”

Adams also alleged that Ratray’s girlfriend “changed her story” after the altercation.

“He’s facing charges now because obviously, she had made the allegations that he choked her,” he said. “And over about a day’s period of time, she changed her story from they had a disagreement or an argument to all of sudden he strangled her.”

Per TMZ, Ratray was later released on a $25k bond. He made his first court appearance in February 2022, where he pleaded not guilty.
