ICM ANNUAL CRISIS REPORT 2023: CONSUMERISM/ ACTIVISM This category tanked in 2023, dropping to 0.94% from 8.76% in 2022. In one of the most notable events, beer maker Anheuser Busch’s Bud Lite beer lost its luster and its place atop the market following an ill-conceived promotion for March Madness (the annual NCAA basketball tournament) with transgender activist Dylan Mulvaney. Conservative backlash helped drive a 13.5% drop in revenue at its U.S. division. Social movements grew despite less media coverage. In the U.S., activism activity around causes like gun safety, climate change, abortion access and transgender healthcare continued to make inroads. In January, a group of young activists gathered in Las Vegas demanding that industry leaders prioritize their safety. Students in Florida organized a mass walkout of schools in protest to some of Governor DeSantis’ conservative legislative moves. Students also played a key role in a Nashville, Tenn., demonstration following a school shooting. On the other side of the political spectrum there were increasing numbers of boycotts against companies that have supported the LGBTQ+ community, including Target, Disney, Starbucks and Barstool Sports. ICM ANNUAL #CRISIS REPORT 2023: #CLASSACTIONS Class action stories skyrocketed by nearly fifty percent to 11.37% of stories ICM tracked. According to Cornerstone Research, there were 83 settlements in 2023, 22 fewer than in 2022. Among these, 34% settled for more than $25 million, the highest percentage since 2012. Securities class action suits recovered nearly $8 billion for plaintiffs globally. Among the high-profile cases resolved in 2023 were two against mega bank Wells Fargo for an aggregate of $1.2 billion and a $450 million settlement with food giant Kraft Heinz. Other settlements included Exelon, $173 million; Allianz Global Investors, $145 million; McKesson, $141 million; and Cardinal Health, $109 million. In fiscal 2023, the U.S. Equal Employment Opportunity Commission (EEOC) received 81 thousand complaints, filed 143 merits lawsuits and resolved 98 suits, obtaining more than $22 million for victims of employment discrimination. Ninety-two of the new suits were for alleged Title VII violations. Title VII prohibits employment discrimination based on race, color, religion, sex and national origin. Allegations included retaliation and discrimination based on gender, disability, rage, age and religion. Another 49 suits alleged violations of the Americans with Disabilities Act. "In the deal with the department, outlined in part in the court filing, Boeing also agreed to pay a $487.2 million fine — the maximum allowed by law — and invest at least $455 million over the next three years to strengthen its compliance and safety programs." While not unprecedented, it is unusual for a corporation to be criminally charged, and rarer still for the entity to plead guilty. The almost $1 Billion cited in this article is on top of the hundreds of millions this #crisis has already cost the company. We can only hope that strengthening its compliance and safety programs includes updates to the #crisismanagement and #crisiscommunication plans.
