This week the Fifth Circuit held that the Universal Service Fund (USF)’s Fee is an unconstitutional “double” delegation of powers. Today the Supreme Court of the United States ruled in a 7-2 decision in the case of Moore v. United States that the Mandatory Repatriation Tax was constitutional. “This is a narrow decision focused on the one-time international tax that was challenged. But the Court makes clear it is not opening the door to a wealth tax, which would still face constitutional problems as a tax on property,” said Joe Bishop-Henchman. https://lnkd.in/ev7-PNW3

State and local governments are currently embroiled in legal battles against (mostly) American energy producing companies, seeking monetary damages against energy producing companies for climate change under public nuisance and consumer protection laws. If the goal here is to obtain funding for environmental mitigation efforts, there are better alternatives to do so. Americans have spent 6.5 billion hours preparing their income tax returns, with an opportunity cost of over $280 billion for preparation alone. The average American individual income tax return now takes 9 hours to complete. In total, the economic burden imposed by tax code compliance reaches $414 billion.
