Update on the Ashburton Salt Project's Environmental Review Process 🌿 We're moving forward on the Ashburton Salt Project with the same commitment to transparency and community engagement that has guided us from the start. Following the closure of the public comment period on September 4, we have now received the collated submissions from the Department of Water and Environmental Regulation. Our team, in collaboration with environmental and engineering experts, is diligently preparing responses and additional information required. Once our responses are finalized, they will be submitted back to the Department to continue through the subsequent stages of the approvals process. Here’s a brief reminder of the steps ahead: 1️⃣ Review by the EPA of our responses and additional information. 2️⃣ Assessment by the EPA, followed by a recommendation. 3️⃣ Public release of the EPA’s report and recommendations. 4️⃣ A 14-day appeal period following the EPA’s decision. 5️⃣ Decision by the WA Minister for Environment. 6️⃣ Assessment by the Commonwealth Department based on the EPA's report. Your support has been instrumental, and we extend our deepest thanks for your active participation in this journey. Transparency and engagement remain our top priorities on the Ashburton Salt project, and we will continue to keep our community informed at every stage. Together, we are #StrongerWithSalt ! #AshburtonSalt #CommunityEngagement #EnvironmentalStewardship #KplusS

On June 28, 2024, the United States Supreme Court in Loper Bright Enterprises v. Raimondo and Relentless, Inc. v. Dept. of Commerce overruled so-called Chevron deference — a 40-year-old precedent that afforded deference to certain statutory interpretations by federal agencies. While the decision represents a significant reduction in agency authority, its practical impacts in the areas of environmental, energy, and natural resources regulation will not be known for years and may be less than many anticipate. "For now, especially for members serving with a federal agency, it’s important to work towards environmental stewardship as one and recall our shared goals, especially with so much divide, change, and turmoil recently. Additionally, in such a dramatic phase of world events and such it’s necessary to practice our own climactic resilience by continuance of our service to the environment, eachother, and the wellbeing of Americans." ✍Emma Klemmensen, Mankato 2 Field Crew Member R️ead Emma's blog post about the recent Supreme Court ruling overturning the Chevron Deference Doctrine: https://lnkd.in/gy_vrKJH [Image Description] U.S. Supreme Court Building. News Update: Texas agency to vote Wednesday on expansion of Valero refinery in Corpus Christi Tomorrow, the Texas Commission on Environmental Quality is set to decide the fate of a planned refinery expansion in Corpus Christi, Texas. The three-member Governor-appointed group will vote on a permit that, if approved, would allow Valero to expand its oil refining capabilities at their Corpus Christi West plant. Valero faces an uphill battle after local opponents including Citizens for Environmental Justice secured a legal win from a Texas State administrative law judge last year. The judge is recommending that the permit be denied, because Valero’s planned expansion project fails to meet federal Clean Air Act rules to limit emissions of smog-forming nitrogen oxides, which damage people’s respiratory systems and are linked to long-term lung conditions. “We expect the Commission to accept the fact findings and legal conclusions of the judge who heard all the evidence and determined that this permit should be denied,” said Environmental Integrity Project attorney Ilan Levin. CBI, working with the Pipeline Safety Trust, assisted the industry, government, and public sectors to create a new recommended practice (RP) for pipeline operators across the U.S. This four-year process of intense research, discussion, and negotiations completed this month. The resulting rigorous set of practices includes how best to share information to the greatest extent possible, how to engage diverse and diffuse audiences, and how to incorporate environmental justice concerns meaningfully into public engagement programs. The RP will ultimately help to improve pipeline safety and environmental stewardship. After registering for an account, you can find the RP here: https://lnkd.in/eR2ZKW46

This first installment examines two U.S. Supreme Court cases that call into question 40 years of precedent related to judicial deference granted to agency rulemakings (Loper Bright Enterprises, et al. v. Raimondo, No. 22-451, and Relentless, Inc. v. U.S. Dep’t of Commerce, No. 33-219). In reviewing these cases, there are indications the Court may overturn its landmark decision in Chevron v. Natural Resources Defense Council, placing new limits on agency power and making it easier for businesses to challenge federal —including environmental — regulations. #ChevronDeference #SCOTUSrulings #agencypower
