After 17 years in the electrical industry, I didn't transition to the tech sector to distance myself from the construction world I love so much. Instead, I was captivated by a software that I believe can revolutionize how subcontractors track and execute their work — an area largely overlooked by many construction tech companies. For far too long, these tech companies have zeroed in on systems that predominantly serve general contractors, often overlooking needs of subcontractors. They've been emphasizing large milestones and reactive issue tracking, rather than enabling subcontractors to focus on the hundreds of steps required to achieve those milestones or developing subcontractor-specific proactive workflows. Consequently, many subcontractors view construction tech either indifferently or unfavorably. Many fail to see the advantages of digitizing their existing proactive workflow methods for internal utilization and leveraging that data for the broader success of a project. That is the point of this article; Fieldwire by Hilti does things differently and wants to empower the subcontractor to help drive success for the project, which equals success for them. In the bustling city of Metrotech, Skyline Construction Company subcontracted Apex Electrical to install the electrical systems for the highly anticipated Orion Tower. Despite their reputation for precision, Apex's project manager, Jenna, overlooked a minor contract clause requiring daily progress reports by 5 PM. Caught up in on-site issues, Jenna missed the deadline, assuming it was a trivial formality. The next month, Skyline's project Manager, Mike, received a penalty notice for $10,000 in liquidated damages for each day a report was late. This oversight cost Apex Electrical significantly, highlighting the importance of adhering to even the smallest contractual details. Jenna learned a valuable lesson: in construction contracts, no detail is too small to ignore. The above is silly story right?.....Wrong! last week Contract Guard was tasked with reviewing a $7+ million dollar shoring contract for a subcontractor in Victoria. Scope of works involved shotcreting, ground anchors and soldier piles with external dewatering and deep well inside the perimeter along with installation of a recharge system. Typically, commercial contracts include both delay costs and liquidated damages. However, it is crucial to understand what the head contractor means by delay costs and how the various clauses of the contract are interconnected. In this case, submitting the daily report was indeed a contractual requirement. Failing to do so could put the unsuspecting subcontractor directly into the liquidated damages zone, as surprising as it may seem. Interestingly, the head contractor has unfortunately gained a reputation for employing such unscrupulous practices in the past.
