This year, the salary structure has undergone regulatory changes, encompassing the base salary, supplements, and other benefits. A significant modification pertains to performance-related supplements, such as incentives. However, these changes deviate from the Minimum Wage Act, incorporating the variable part of the salary, tied to performance, into the minimum wage. All salary supplements can now contribute to the minimum gross wage with few exceptions, allowing employers to decrease the base salary by augmenting supplements for work performance. When an employer negotiates the base salary below the minimum gross wage but with a bonus based on achieved results, concerns arise about addressing this situation. Business Owner Alert 🚨 There are new salary thresholds for exempt employees under the Fair Labor Standards Act (FLSA) coming into effect on July 1, 2024, to compensate employees fairly for their long hours of work. Here are a few of the changes coming: 1️⃣ The salary threshold for these employees will increase to the equivalent of an annual salary of $43,888 (up from $35,568) and will again rise to $58,656 on Jan. 1, 2025. 2️⃣ The Highly Compensated Employee (HCE) exemption will rise to $132,964/year in July and $151,164/year in January 2025. 3️⃣ These salary thresholds will be updated every three years starting in 2027. Employers— now is the time to audit your employees’s exempt status and salaries to ensure compliance with the Department of Labor’s final rule ahead of the upcoming deadlines. You must either increase the salaries or reclassify any employee who no longer qualifies as exempt due to the increased salary thresholds to remain compliant.
