According to a recent poll, 73% of voters (including consistent representation from Republicans, Democrats, and Independents) support maintaining the ban on charities and churches endorsing or opposing political candidates. However (and importantly), 71% of respondents agreed and would support clarifying legislation to spell out exactly what is allowed when conducting nonpartisan civic engagement. Will the IRS scrutinize the political activities of charities more closely this year and next as another election season approaches? We will see.

A recent Houston Chronicle article by Alex Daniels [Research shows nonprofits are doing less lobbying - Aug. 13, 2023] shared that 20 years ago, 3/4 of nonprofit organizations actively advocated for policy issues. Over the past 5 years, that formerly significant number is down to less than a third of nonprofits participating in any policy or legislative lobbying. As a 30-year+ nonprofit professional (25 years as an Executive Director, now 8 years of nonprofit consulting), this trend is worrisome. While the article says there will be further studies as to the "why", my experience with nonprofit clients is that their board is often operating under a key incorrect assumption. Their fear, often dictated to staff, is that they're not allowed to engage in any kind of lobbying lest their 501(c)3 status get immediately ripped from them. While it's absolutely correct that nonprofits cannot rally behind any one particular candidate for elected office, it doesn't mean they can't hold a forum of all candidates for any particular office (related to their mission) for their members to see and hear their options to make their own educated voting decisions. And while nonprofits can't spend their entire budget drafting legislation, they can certainly spend a portion of their income doing so. I'll be doing a series of articles in the following weeks of advocacy work that can be done without worrying about budget expenditures. And then I'll share in subsequent postings some suggestions of what nonprofits CAN spend money on in the specific "lobbying" arena...and why they should. I'll be interested to hear how YOU spend your funds on lobbying; or if you've been under the assumption you can't! This needs to be a louder conversation leading to more direct action within the nonprofit community. Your mission matters, and more elected officials need to know why your knowledge of "x" issue should matter to them. Legislators from the county, state and yes, even federal level cannot be and are not experts in every arena. You need to become the go-to source for the press, and serve as witnesses at legislative hearings. You're the expert in your arena; own that space and help others make the right funding and "attention" decisions; you can't do that without active advocacy. #nonprofitmanagement #nonprofits #nonprofitleaders #advocacy #lobbying #profitablenonprofits
