A hot news from California: A CA court of appeals has reversed the lower court’s decision, meaning that the CPRA can now be enforced immediately. Enforcement was originally expected on July 1, 2023, then delayed to March 29, 2024, but now, regulators are assumed to expect companies to come into compliance immediately. https://lnkd.in/eF_7TwMZ Once Again Meta is under the lens of the regulators, and this time in Germany: In a recent case, the Düsseldorf Higher Regional Court made a significant ruling against Meta Platforms Ireland. The court found that Meta's use of unclear order buttons in their paid ad-free service on Facebook and Instagram violated consumer protection laws. Keller and Heckman LLP Partner Sheila Millar was quoted in the Bloomberg Law article, "Meta’s Dispute Over Addicted Kids Reignites Age-Proofing Fight." The article discusses a lawsuit brought by California and multiple state attorneys general against Meta Platforms Inc. for allegedly violating federal children’s privacy law by failing to get parental consent to collect data of users younger than 13. The state attorneys general argued that Meta could have used "feasible alternative age verification methods." Regarding age-verification methods, Sheila pointed out that "you can age-screen to determine that this person behind the screen is likely to be a child. Good move by State Attorneys General. This may seem like a peripheral issue as related to data privacy, but the goal of keeping children online is to create and promote habits that allow for the collection of behavioral and private data. From the article: "Meta designed its Facebook and Instagram products to keep young users on them for longer and repeatedly coming back, the attorneys general allege. A very simple equation Online safety for children and teens = long term safety as they reach adulthood. Kids are exposed to much content they are not able to process emotionally and this can have long-term negative effects on their lives. This is a challenge which must be tackled quickly and properly.

Meta's platforms are increasingly important to teens — it’s how they discover new things, communicate with friends, and express themselves. As part of our ongoing efforts to provide them safe and age-appropriate experiences, we're introducing new protections that focus on the types of content teens see on Instagram and Facebook: ❌ Hiding more types of content for teens in line with expert guidance. 🛠️ Automatically placing them into the most restrictive content control settings and restricting additional terms in Search on Instagram. ✅ Prompting them to update their privacy settings on Instagram with new notifications. Today’s announcement is encouraging and yet another step forward in improving our technology and enforcement efforts to make sure teens are safe, secure and supported. Some of you may have watched this week some clips of the tech CEOs being "grilled" by politicians in the US Congress. There's an element of entertainment to all this, a façade of theatrics that benefit both parties, giving a platform for the CEOs to show remorse and that they are dealing with the problem, a chance for politicians to score some popularity points. Still, if it can get the ball rolling on legislation and conversations started on online safety for kids, all the better. 📜 Underlying all this is "Section 230", a federal law in the USA which holds that tech companies cannot be held liable for the content that users post to their platforms. On the surface, it makes sense. If a user posts violent/discriminatory/abusive content, then this user is the one responsible, not the media they used. People should be held responsible for their actions which, of course, is true. But the more you look into it, the more you realise this emphasis on the individual is a "laissez-faire" approach, one for example used by the gun lobbyists in the USA to stifle debate and reform efforts. It's not the tool they say, it's the way you use it. 📱 This is true up to a certain extent. But let's not forget how powerful a smartphone and its accompanying apps can be. Ask the parents, who courageously went to Washington and made their presence felt in Congress, whose children - as a result of social media use - suffered, made illicit drug deals, were victims of sexual violence and extortion or committed suicide. Yes, education is key. Children need to understand how algorithms work, what is the cost of these "free" services, the consequences of making content public, etc. But is there no room for legislation to curb the excesses and add extra layers of protection for kids? There has been some pushback against parts of the proposed legislation, the Kids Online Safety Act, from certain advocacy groups. There are some genuine concerns for freedom of speech that need to be acknowledged and addressed. ➡ These discussions need to be had away from the tentacled lobbying of the tech industry.
