It’s January 3 and today was a good day in 1959. In 1867, the United States signed the Treaty of Cession with Russia, securing about 370 million acres of mostly pristine wilderness for the modest price of $7.2 million. Reactions to the purchase were mostly positive, but some saw it as useless land and labeled it "Seward's Folly", referring to then U.S. Secretary of State William H. Seward. And they weren’t wrong for a while – Alaska remained sparsely populated until the Klondike Gold Rush of 1896 threw open the doors for those seeking fortune. By the mid-20th century, the territory of Alaska's vast resources, including oil, timber, and fisheries, were attracting investment. As the population increased and economic interests flourished, the need for local governance became apparent. Ernest Gruening, a territorial governor for over a decade, and E.L. Bartlett, Alaska's non-voting delegate to Congress for 14 years, tirelessly lobbied for statehood, emphasizing the economic potential of the region and the importance of representation in Congress. Their efforts culminated in the signing of the Alaska Statehood Act by President Dwight D. Eisenhower on July 7, 1958. And on January 3, 1959, Alaska officially became the 49th state of the United States. Gruenig and Bartlett would both serve as Alaska's first U.S. Senators. When I was counsel at the Supreme Court of Canada for R v. Marshall, this year being the 25th anniversary of the deicision, I was opmistic that after a shorter transitional period - 5, maybe even 10 years post decision - fair fisheries allocations would have been negotiated for each First Nation. It’s outrageous that 25-years post-decision we’re still nowhere near that point, as the Crown refuses to honour Treaty rights unless effectively non-Indigenous fishers agree. We all have to remember that unlike the west coast where Indigenous fishers have traditionally held a 1/3 interest in fish catches, on the east coast it was under 1%! It’s the Crown’s duty, and not the job of non-Indigenous fishers, to honour all Treaty rights. The SCC spoke clearly 25 years ago this coming September. The Crown did initially act, investing $600 million in post-Marshall initiatives. But Marshall arguably remains the SCC’s most significant affirmation of Treaty rights to date. What isn’t the Crown still listening?
The need for increased access to the lobster fishery for First Nations is a problem across Mi’gma’gi. Canada—finally—recognizes treaty rights to participate in the commercial fishery. But DFO policy hasn’t caught up. The DFO insists that all new First Nations access be purchased from established non-Indigenous fishers willing to sell their licences. Commercial interests are allowed to trump treaties. Even with recognized constitutional rights, First Nations are still treated as second class resource users. Honouring the treaties means putting First Nations first. #reconciliation #peaceandfriendship
