A coalition of civil society organizations including the Canadian Civil Liberties Association (CCLA) held a conference on Nov. 2 concerning Bill C-27, otherwise known as the Digital Charter Implementation Act. The group outlines its concerns with the proposed legislation and calls for amendments to the bill in its current form. The bill passed second reading in the House of Commons Key Recommendations made earlier are 1) Recognizing privacy as a fundamental human right; 2) Removing AI regulation from ISED’s sole jurisdiction, given ISED’s mandate to bolster the AI industry conflicts with the public interest in regulating the potential dangers of AI; 3) Addressing poorly defined language in AIDA that create loopholes and a lack of enforceable rules; 4 ) Committing to far more active consultation with stakeholders beyond industry insiders; to ensure AIDA and subsequent AI rules are well balanced and rights-protecting; and 5 ) Expanding AI regulation to apply to both the public and private sector including government security agencies. #privacy #privacymatters #privacycompliance

Article 11 of CoE Framework Convention on Artificial Intelligence and Human Rights, Democracy and Rule of Law, approved on May 17, 2024 by the Committee of Ministers of CoE: "Article 11 – Privacy and personal data protection Each Party shall adopt or maintain measures to ensure that, with regard to activities within the lifecycle of artificial intelligence systems: a. privacy rights of individuals and their personal data are protected, including through applicable domestic and international laws, standards and frameworks; and b. effective guarantees and safeguards have been put in place for individuals, in accordance with applicable domestic and international legal obligations." Convention covers public and private sectors. It will be open for signature from September 2024 onwards. #AI #CoE

Open Letter from Office of the United Nations High Commissioner for Human Rights on the European Union Artificial Intelligence Act #EUAIAct In line with recommendations discussed in the convenings with Brussels Privacy Hub and Global Network Initiative a few weeks' back in Brussels and the EP, this letter emphasises the feasibility of fundamental rights impact assessments in the #EUAIAct. Assessing adverse impacts on human rights is a core component of human rights due diligence, both for private and public sector use of AI, and follows from international human rights law and the UN Guiding Principles on Business and Human Rights #UNGPs. #bizhumanrights OHCHR’s work with leading AI companies in the context of the Office of the United Nations High Commissioner for Human Rights B-Tech project demonstrates that assessing adverse impacts of AI on people is the “art of the feasible”. The fact that some companies at the forefront of AI development are endorsing and implementing a rights-based approach to risk management points to fundamental rights as a promising foundation for rights-respecting AI practices also in the #EUAIAct context.
