Ohio man found sane for Batman movie weapons case trial

Scott A. Smith, an Ohio man arrested with a loaded gun, ammunition and knives an Aug. 4 showing of "The Dark Knight Rises", has been declared sane to stand trial.

CLEVELAND (AP) -- An Ohio man arrested with a loaded gun, ammunition and knives at a showing of the latest Batman movie has been found mentally competent to stand trial.

The defense and prosecution in the case against 37-year-old Scott A. Smith, of North Ridgeville, told the judge on Monday they accepted the findings of the court-ordered psychiatric exam.

The trial is scheduled for Dec. 10.

Smith faces two concealed weapon counts and one of having a weapon under disability, which prosecutors say is drug dependency. He was arrested at an Aug. 4 showing of "The Dark Knight Rises" in Westlake.

His attorney says Smith had the weapons for protection in case someone tried to copy the Colorado theater shooting that left 12 dead.
