Trump Gets Major Delay in NY Trial
Due to the U.S. Supreme Court’s presidential immunity ruling, Judge Juan Merchan delayed the sentencing in President Donald Trump’s New York trial until September 18. Will DA Alvin Bragg be forced to reopen the trial after much of his evidence included “official acts” from when Trump was President?
The delayed sentencing date is huge for two reasons. First, much of the far Left hoped that the attention would shift from President Biden’s poor debate performance to Trump’s original sentencing date of July 11. And as we said last week, it will not be good news for President Biden if the media is still talking about replacing him after the long Independence Day weekend.
Right now, the narrative isn’t shifting for Biden. Yesterday, the primary topic at White House Press Secretary Karine Jean-Pierre’s press conference was President Biden’s fitness for office. Also, an internal Democrat election poll was leaked that sounded the alarm for Biden’s reelection in swing states, and Trump is way ahead in fundraising now following the debate.
The second reason that the delayed sentencing is significant comes from Judge Juan Merchan’s letter regarding the delayed sentencing: “The Court’s decision will be rendered off-calendar on September 6, 2024, and the matter is adjourned to September 18, 2024, at 10:00 AM for the imposition of sentence, if such is still necessary, or other proceedings.”
Did you catch the important nugget: “if such is still necessary, or other proceedings”? In other words, the Supreme Court’s decision could derail Bragg’s case altogether. Within hours of the Justices’ decision, Trump’s lawyers contested this issue, setting off the chain of events leading to the delayed sentencing – a lot of movement happened quickly.
Bragg had presented a broad case that ignored expired statutes of limitations and elevated what would have been a misdemeanor into 34 felony counts. Yet by going so broad, Bragg might have tanked his case completely by presenting evidence that would now be considered inadmissible.
Trump’s lawyers filed a brief to have the jury’s verdict vacated, and the other side will be filing a brief in response. Judge Merchan will review the briefs (which the caveat “if such is still necessary” refers to) before the sentencing date. The judge might not have a reason to sentence President Trump at all.

The Supreme Court agreed with our amicus brief in support of presidential immunity. The ruling is good for the office of the President and a huge win for former President Trump. As we’ve seen with the repeated targeting of Trump, prosecuting Presidents could become routine if the Constitution is ignored. The nature of presidential power entitles the President not just to immunity but to presumptive immunity for all official acts, meaning it’s presumed that the acts of the President are “official acts.” The Justices’ ruling sends the decision back to lower courts to determine which of Trump’s acts were official.
What does the high Court’s decision mean for the outstanding cases against Trump? The ruling should be a death blow to Special Counsel Jack Smith’s case against Trump, and we expect to see motions to dismiss. This will also likely end Fani Willis’ case against President Trump in Georgia – under the Court’s analysis, the phone call in question in her case should be considered an official act. Smith’s classified documents case will have trouble as well since the documents in question were moved during Trump’s presidency.

The Left Suffers Massive Defeat in New York
Representative Jamaal Bowman (NY-16) was the first ever “Squad” member to lose a primary race – proof of the growing divide within the Democrat Party over Israel. The “Squad” – or rather the “Hamas Caucus” – has gained sizable traction in the last few years in the House, and this loss is a big blow to their cause. Rep. Bowman was one of 37 Democrats who voted against sending aid to Israel. He also voted against the Abraham Accords, meaning he didn’t want Israel to have a better relationship with other Muslim countries, among other radical anti-Israel measures.
In other words, Bowman is as anti-Israel as you can be in New York, which has a strong Jewish population. However, he just got it handed to him in the primary. The votes are still coming in, but it looks like Latimer will take close to 60 percent of the votes. Clearly, the 16th congressional district has had enough of Bowman’s antisemitic, bizarre antics. (Don’t forget that he also once pulled a fire alarm to stop a congressional vote and is known for using extremely foul language at rallies.)
Bowman didn’t hold back in blaming the AIPAC (American Israel Public Affairs Committee) for his loss: “We should be outraged when a super PAC of dark money can spend $20 million to brainwash people into believing something that isn’t true. We should be outraged about that.” If the funds were dark money, how did Bowman know how much was donated? Also, it shouldn’t be shocking that AIPAC would support a candidate who isn’t so vocally anti-Israel.
Unseating a sitting incumbent is not easy. However, Bowman clearly ignored his constituency with his radical antisemitism, and the votes show that. Losing by double digits is a shocking defeat.
Don’t doubt Bowman’s loss also isn’t a wake-up call for President Biden. The growing divide within the Democrat Party is forcing Biden to walk a fine line between supporting Israel and creating distance with Israel. Though the pro-Israel candidate ultimately won, Bowman still got 40 percent of the vote, so how does the President appease the radical base? President Biden has been trying to have his cake and eat it too on the topic of Israel, and it could backfire.
And what does Bowman’s defeat mean for the general election? President Trump had a massive turnout during his recent Bronx rally. New York could potentially be on the table for Trump. Many polls show Biden only leading by single digits in the state.
Former Rep. Tulsi Gabbard reacted to Bowman’s loss:
“I think that it is a positive sign that there is a movement inside the Democrat Party – or at least inside voters in New York in a district that probably leans very Democrat – that they don’t want these kinds of extremists who are really toeing the line on racism and antisemitism and encouraging violence against Jews . . . to be representing them in Congress. And there has been increasing violence against Jewish people. . . . [Some are] literally going out and chasing them down and hunting them down. It’s a terrifying time to hear from our Jewish friends sincerely questioning whether or not it is safe to . . . raise their kids and their families in the U.S.”
The primary loss sent a shockwave through the far Left. The first presidential debate is tomorrow night. Let’s see if President Biden addresses the topic of Israel.
