Is it a requirement that the theme name can’t be taken on other marketplaces?

This same theme is also already live under the name "Muscat": ​https://wordpress.com/theme/muscat?tab_filter=all

The theme name is already occupied before you release this theme. So, if the theme name is occupied, we can't really accept that theme.
