“ICC prosecutor threatens US senators,” by Elliott Abrams, JNS, May 29, 2024 (thanks to The Religion of Peace):
Many critics thought the International Criminal Court had gone too far when its prosecutor asked for arrest warrants against Israel’s Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant.
But as the saying goes, “You ain’t seen nothin’ yet.”
Now, the prosecutor’s office has threatened to prosecute criticism of…himself. Those who seek to defend Israel and stop the malicious, deeply antisemitic action against its leaders and against the Jewish state are now being told that their words and actions may also be a crime.
This may sound like something out of “Alice in Wonderland,” but it is an effort not only to limit freedom of speech, but to limit the constitutional powers of the U.S. Congress.
After the prosecutor called for the arrest warrants for top Israeli officials, 12 U.S. senators wrote to the ICC. The full text of the letter is below. The final paragraphs read:
“If you issue a warrant for the arrest of the Israeli leadership, we will interpret this not only as a threat to Israel’s sovereignty but to the sovereignty of the United States.
“The United States will not tolerate politicized attacks by the ICC on our allies. Target Israel and we will target you. If you move forward with the measures indicated in the report, we will move to end all American support for the ICC, sanction your employees and associates, and bar you and your families from the United States. You have been warned.”
The reaction of the prosecutor’s office came in a tweet, the key language of which is this:
“When individuals threaten to retaliate against the Court or Court personnel…such threats, even when not acted upon, may also constitute an offence against the administration of justice under Art. 70 of the Rome Statute.”
Wow.
The 12 senators are already criminals, according to the ICC prosecutor, for writing their letter—even if absolutely nothing else happens. Note that the prosecutor writes of “individuals” who may threaten the ICC, whereas the senators write as U.S. government officials about possible official U.S. government actions. In plain language, the prosecutor is arguing that he and the ICC are above criticism. Forget freedom of speech or national sovereignty. To say that the United States, which is not a party to the Rome Statute, might react to punish the ICC for illegal and immoral actions it and its employees may take is not permitted….

Lawmakers make laws. Police arrest, prosecutors prosecute and Judges and Justices apply the laws in the courts. Prosecutors can bring charges, but they don’t make laws according to what they wish.
Judges can’t apply laws until a case is before them is the courts.
This creepy no-good can’t decide what is a crime and what is not…he can only apply the law in court, a court in which he is allowed to ‘prosecute’ a crime.
Just who is he claiming has written and passed a law saying he can’t be criticized?
Threatening U.S. senators…I believe Sen. Cotton was one of those who wrote the letter….is a crime. Issue some arrest warrants for this pretend ‘prosecutor.’
And if he is in the U.S., send him packing.
At this time, we still have a measure of freedom of speech, and the Senate still has some legal authority to let such as the thugs of the icc know what will happen if they proceed with their out-of-control actions.

First, the law is about legal vs. illegal (and as history shows that depends). I dont think right vs.wrong is even considered in legal matters. No, It shouldn’t be that way but right now it is because we allow it. We have a lot of work to do to get our country back on track. I’m older, had fun in freer funner times in the USA, Even back then it was not easy for many to make ends meet but, we got by, we survived, didn’t we? It wasn’t a magic carpet ride although compared to today you could almost describe it that way. Back then… if I had only known… So, my concerns today are not for me but for the younger generations of Americans that have come after me.

Pure facts are definitely issuing from you!!! The lush comfort of the booming years did indeed make we boomers oblivious to the perils of prosperity. We produced Joe Biden and Angela Merkel right on time for the dissolution of The West in their hapless administrative reigns. The stupor of prosperity nearly always if not certainly always produces philosophical extravagances such as DECONSTRUCTIONIST WOKEISM of the sort we see today. The frisson of self-annihilation is evidently too mesmerizing for these spoiled dopamine addicted college brats to resist. Thinking that existential concerns can be magically resolved with hyper-cerebral verbiage these pathetic children subconsciously think that someone something or somehow their redemption will spontaneously appear like in the reality shows they continually engorge. Shariah will be the antidote to their catatonic stupor. In the meantime the specter of DEADLY INSIDIOUS JIHAD LOOMS ON THEIR FUTURE HORIZON. If the West does not adapt a scorched earth policy that everyone on earth can understand it is an absolute certainty that we are selling our clueless future generations into a cruel subjugation by a merciless bigoted anti-Christian society we cannot fathom in our darkest nightmares.

Yes, the complaints about what becomes a crime are many, but the first one is that a group of rich and powerful people get laws passed to suit them.
If a group of rich and powerful people want something the poor, powerless, etc. do to be illegal, they pass a law against it, making it a crime. (all those laws about dancing, chewing gum, etc. because the r and p wanted them)
But, it is still true in the U.S. that a certain group write and pass laws the rest of us are obligated to obey.
This prosecutor in another country has no authority to declare something to be a crime because he wants it to be a crime, and to expect the Senators here to abide by his declaration based on his wishes.
Each place where there is some form of government…even tiny towns…make laws that may not apply in other places.
His declaration and threat has no place in the U.S.
I hope Sen. Cotton and the others tell him to go fly a kite and then keep him, his family, his close friends and his cat, out of the country.

I read that free speech is the primary target of many and a large part of their animosity towards the US. While they’ve so widely and effectively been able to restrict the ability to criticize, the First Amendment stymies their efforts and must be dealt with, to their thinking.
Hoi Polloi says
More fully as I had to be out the door earlier, I read an account of the aftermath of this incident: “Murder of James Bulger On 12 February 1993 in Merseyside, two 10-year-old boys, Robert Thompson (born 23 August 1982) and Jon Venables (born 13 August 1982), abducted, tortured, and murdered a two-year-old boy, James Patrick Bulger (16 March 1990[2] – 12 February 1993).[3][4] Thompson and Venables led Bulger away from the New Strand Shopping Centre in Bootle, after his mother had taken her eyes off him momentarily. His mutilated body was found on a railway line two and a half miles (four kilometres) away in Walton, Liverpool, two days later.”
The fiends were given release and altered identities. Venables couldn’t stay away from minors or out of legal trouble, nor could he keep his mouth shut. His new identity was thereby uncovered. UK authorities couldn’t prosecute or prevent dissemination of information in the US due to citizens’ rights and have been very frustrated that the US will not comply with their demands that information about Venables continues to come to light, I have read.

You are right….Freedom of Speech is the main target, along with choosing a belief system (religion).
h. clinton was working with the mozlums back in 2011 to get Americans to shut up, and told them that the First Amendment wouldn’t allow for a law telling us talking about islam would be a crime. She said ‘shaming’ Americans would have to do.
And I have heard about the case you referenced here. Terrible thing to be done to a small child, a baby, and terrible still that two young boys had such evil in their hearts. One has to wonder who gave them the idea for such a thing.
I’m glad to know the First Amendment is frustrating to those who wish to hide behind curtains so their evil can spread, while they remain free of punishment.
The power of speech is a True Gift from a Wise Creator….given freely.
Hoi Polloi says
All true. Faith in God is the actual main target. And I thank you for bringing that to light about HRC.
somehistory says
Thank you, HP, “Faith in God,” is what it’s all about>and I’m happy to keep reminding …myself….and any others interested, about what clinton was trying to do.
CalvinsLutheran says
This in itself shows the need for international level checks and balances.
carpediadem says
Unless you have people of good faith in those offices, checks and balances will be misused as the ICC is misused.
CalvinsLutheran says
This is a godsend because it clearly shows how unrestrained the hubris of the ICC has become. Since when were these folks empowered to even IMAGINE they could go there? Oops I forgot the Woke Left aids abets and accommodates this EXACT line of reasoning. So considering how loopy their constituency on the Left is we must remain vigilant for an unexpected and unending bureaucratic psychopathology from this vile entity.
Taffy says
You hit the nail on the head! If there were any doubt that the ICC were not a kangaroo court, all doubt has now been removed!
Hoi Polloi says
Kangaroo courts are outing themselves all over.

The UN, ICJ and the ICC are all part of the same organization, the UN, although they are considered separate from each other.
None can make or enact ‘international law’ nor can they truly enforce any decrees they make.
The scary thing is that the UN truly wants to become the ‘official law-making body’ for the world and its actions over the past 30 years supports this.
Its ‘original’ purpose was to mediate difficulties between countries and try to reach a solution to prevent the possibility of war. This was accomplished through treaties…’not law’. All treaties are voluntary and a country can withdraw from any treaty if it feels it should. The UN and some of its affiliate organizations, though, like the ICC and ICJ have tried to push the idea that ‘they’ make international law when, in fact, they don’t. It seems to be working, too, as many people seem to believe that they do make international law.
The absolute bias of the UN and its affiliates towards most world problems is astounding. They have come to support terrorism, especially if it involves ‘the religion of peace’. They ignore all the crimes against humanity or war crimes committed by ‘certain’ terrorist groups.
I say it is time to dismantle the UN and all its affiliate organizations and start with a clean slate.

My question to the ICC prosecutor is…how many reliable divisions do you have on hand to enforce this self-serving, attempted cover -up of really bad behavior, edict? Since you seem to need it I will help you out. None, is the correct answer.
Lyone Fein says
Absolutely correct! The ICC and the ICJ are toothless organizations. Totally symbolic. And everyone seems perfectly happy to keep them this way!

I’ve become convinced that most of what we hear condemning Netanyahu is in the same vein as we hear condemning Trump: it’s not about truth, it’s about getting rid of an inconveniently stubborn roadblock to someone else’s plans for dominance.

If Senator John McCain had been around he would be chanting “Bomb, bomb, bomb the Hague!”
For him no problem was too big to be solved by bombing the American way!
Please correct me if I am wrong but I believe to remember that the US, which is not a signatory to the ICC in fact has threatened to bomb it should it ever go after US citizens!
Having said that the ICC demonstrated once and for all that it’s calling has nothing to do with law and everything to do with political correctness whatever way the wind is blowing. You simply don’t go after heads of state who enjoy sovereign immunity. Any sober law student knows that.
But the Netherlands is a NATO member, a friend and ally? How can you bomb the Netherlands? Doesn’t matter. The US has two wars going on in Europe at present:
1. A military war on Russia using Ukraine as the war theatre and a whole generation of young Ukrainians to keep it going. That war is twice lost: Militarily and also as a sales promotion of US military technology and equipment, which convincingly shows to place your orders in Russia. Finally, the US has exposed its European allies to mortal danger.
2. An economic warfare on Germany and its friends in Europe to make sure that they do not get ideas of their own. That war has proven highly successful as it has destroyed the European economy. To prevent the risk of European politicians repenting and starting to care for their own people the US for good measure blew up the Northstream I and II pipelines in an act of terrorism. The Wolfovitz Doctrine is working!
From the above perspective carpet bombing of the Hague is unproblematic! O, John McCain would have loved it!
PMK says
Goofy,
I don’t remember the US ever threatening to ‘bomb’ the Hague. In this letter, senators are promising to hold the ICC accountable. According to the letter:
If you move forward with the measures indicated in the report, we will move to end all American support for the ICC, sanction your employees and associates, and bar you and your families from the United States.
As a sovereign nation, the US can deny access to those who threaten its sovereignty. Withholding support from the ICC is not economic warfare. Since the US is not a member, we owe them nothing. What economic warfare is the US waging in Europe?
