Hunter Biden gun trial: All the evidence federal prosecutors plan to use against the president's son

Hunter Biden will be in federal court Monday as the defendant in a bombshell federal gun crimes trial that could span over a week. 

President Joe Biden's scandal-plagued son, 54, is charged with lying about his crack cocaine addiction in October 2018 on a form to buy a gun in Delaware. He has pleaded not guilty and his lawyers insist he didn't break the law and say the case is politically motivated.

On Monday, the jury selection process will begin at 9 a.m. ET and kick off his trial. If found guilty, Hunter faces up to 25 years in prison on the charges.

He was all smiles earlier this month when entering the courthouse for a hearing, but his legal woes are becoming a headache for Joe's re-election campaign.

Hunter is also facing federal tax charges in Los Angeles and is set for trial in that case in September - just weeks before the presidential election.

The firearm report that Hunter allegedly lied on

At the center of the case is a firearm report that is required for a gun transaction. 

He is accused by Special Counsel David Weiss' team of hiding his cocaine addiction on a form when he bought a Colt Cobra revolver for $900 in Delaware in October 2018.

A photo of the form shows Hunter answered 'no' when asked if he was an 'unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.'

If he had answered 'yes,' he would not have been able to buy the gun.

But at the time, Hunter was addicted to crack cocaine, according to a memoir published years later. 

The Colt Cobra cost $886.81, so Hunter handed over $900 in cash, prosecutors allege.

Gun tossed in the trash by Hallie Biden

Eleven days after he filled out the form, his then-girlfriend Hallie Biden - the widow of his late brother Beau - found the weapon in his car with the windows down.

Alongside it were the speedloader and the ammunition. She threw the gun in a trash can at the Janssens Supermarket in Wilmington, across the road from a high school. 

'The police later obtained the gun case from the defendant and obtained the defendant's gun, the ammunition contained in the ammo box, speed loader, and brown leather pouch from the older man,' prosecutors have said. 

DailyMail.com reported exclusively that Hunter tried to blame the missing gun on Mexican workers. 

The First Son made the controversial comments in October 2018 while being interviewed by state police looking for his handgun and bullets after Hallie threw them out.

Text messages with Hallie about the gun disposal 

Texts from the day Hallie Biden discarded the firearm in front of a Wilmington grocery store are also expected to come up in court.

'Are you insane. This is no game. And you're being totally irresponsible and unhinged,' one text message reads from October 23, 2018.

In a follow-up text, he blasts her for disposing of the gun.

'Who in their right mind would trust you would help me get sober?' Hunter asks, referencing that he had an encounter with the FBI over the gun.

The DOJ document notes that the texts came after his 'interactions with law enforcement.'

A response from Hunter's 'girlfriend' read: 'I'm sorry, I just want you to be safe. That was not safe.'

'And it was open unlocked and windows down and the kids search your car,' she continued.

'You have lost your mind hunter. I'm sorry I handled it poorly today but you are in huge denial about yourself and your reality that I just want you to be safe. You run away like a child and blame me for your shit. It's to be expected that you go, you prove repeatedly that you can't stay and really do work on yourself,' she said. 'It's easier for you to avoid looking within and cowardly to constantly point the blame on me.'

In subsequent texts he tells Hallie Biden that he is an 'addict.'

He also tells an individual, labeled 'Person 1' on the filing that 'I'm a f***ing better man than any man you know whether I'm smoking crack or not.

In a final text sent to a 'Person 2' on the filing, Hunter writes: 'I'll fuxking (sic) get sober when I want to get f***ing sober.'

Beautiful Things memoir

Prosecutors also plan to show jurors portions of his 2021 memoir Beautiful Things, in which he detailed his struggle with alcoholism and drug abuse following the 2015 death of his older brother, Beau, of brain cancer at age 46.

Prosecutors have said in filings that he chose to write a memoir where he 'made countless incriminating statements about his years-long drug usage' at the time when he bought the gun.

'He recounted his interaction with a drug dealer who pointed a gun at him during a drug deal before he decided to buy his own gun,' they say.

The infamous laptop 'from hell'

The laptop has been the source of controversy for years after Republicans accessed and disseminated personal data from it. 

Prosecutors disclosed this month that they will be presenting evidence found on the laptop.

Defense attorneys have questioned the authenticity of the laptop's data in court documents, but prosecutors say that there's no evidence the data has been compromised and that a drawn-out fight over it at trial would be a waste of time.

Testimony by Hunter's exes including brother Beau's widow Hallie 

Hunter Biden's gun trial will feature some scintillating testimony from his ex-lovers that could reveal the personal details of his drug use when he purchased a firearm.

The president's son's ex-wife Kathleen Buhle, his ex-girlfriend Zoe Kestan and his deceased brother Beau's widow Hallie Biden - whom Hunter had a romantic relationship with - all could be called to testify, according to court papers.

Though the court filing does not identify some of his former muses by their names, it does clarify that 'Witness 1 was previously married to the defendant' and that 'she would check his vehicle from time to time because she did not want their children in a vehicle with drugs.'

Witness 3, according to the filings 'was in a romantic relationship with the defendant in October 2018, and before and after.'

And it also references another woman who 'was previously in a romantic relationship' with Hunter and 'observed the defendant using crack cocaine frequently—every 20 minutes except when he slept.'

Witness 1 is alleged to be Buhle, 2 to be Hallie Biden and 3 to be Kestan.

Drugs found on the gun pouch

'Furthermore, a chemist was able to confirm the presence of cocaine residue on the brown leather pouch in which defendant stored his firearm,' prosecutors said in recent filings.

iPhone pictures of crack cocaine and drug paraphernalia 

Hunter Biden's iPhone contained pictures of crack cocaine and drug paraphernalia ahead of his October 2018 gun purchase, say prosecutors. 

They say it's evidence that he lied about his addiction when he bought the gun.

'Prior to October 12, 2018 (the date of the gun purchase), the defendant took photos of crack cocaine and drug paraphernalia on his phone,' the documents say. 'Also prior to his gun purchase, the defendant routinely sent messages about purchasing drugs.'

Last year, the president's son had reached a deal after a five-year investigation that would have allowed him to avoid trial for the firearms charges if he abided by parole conditions over 24 months. 

Republicans in Washington complained that the president's son had gotten himself a 'sweetheart deal' designed to protect President Biden.

However, the plea deal spectacularly fell apart in court in July, opening Hunter up to new charges.

Judge Maryellen Noreika questioned the 'diversion agreement' of Hunter's plea deal - a clause that gave him blanket immunity for a wide range of other potential charges, including illegal foreign lobbying - killing the deal.

In August, Attorney General Merrick Garland elevated Weiss to special counsel status after increased scrutiny.

Garland's decision to promote Weiss came after IRS whistleblower allegations that Hunter received 'special treatment' during the criminal probe.
