Effective June 25th: For the first time ever, the EPA has established federal drinking water standards for six PFAS compounds. This includes setting Maximum Contaminant Levels for drinking water for five (5) PFAS compounds—PFOA and PFOS at 4 nanograms/liter (ng/l), PFHxS, PFNA, and HFPO-DA at 10 ng/l. A sixth chemical, PFBS, is also being regulated in mixture, though its regulation individually is being deferred while they research it further. Drinking water providers have until 2027 to implement monitoring and reporting requirements, and until 2029 to comply with these standards. This means that investigations that aim to fulfill CERCLA’s ‘All Appropriate Inquiries’ requirement, including all ASTM-compliant Phase I ESAs, will now need to assess for the possibility of PFAS releases.
